for Rubic Solution

 

  1. Introduction

 

These Terms of Service (the “Terms”) constitute an electronic record as per the Information Technology Act, 2000 and associated rules. No physical, electronic, or digital signature is required for these Terms.

 

This document is in accordance with Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, and defines the rules and regulations, privacy policy, and user agreement for accessing or using the “App”.

 

These Terms form a legally binding agreement between Rubic Solution LLP (referred to as “Lead Atmos,” “We,” “Us,” or “Our”) and you, the user (referred to as “You,” “Your,” or “User”). They are effective upon acceptance, which may be signified by clicking the “I Accept” button, using the “App,” or by other electronic means.

 

Please read these Terms carefully. By using the “App,” you agree to these Terms. If you disagree with any part of these Terms, you should not use the “App.” You consent to the terms under Section 43a and Section 72a of the Information Technology Act, 2000, and the Information Technology (Intermediary Guidelines) Rules, 2011.

 

  1. Agreement Overview

 

The “App” refers to the mobile application available on Google Play Store and associated mobile sites or applications. This agreement is between Rubic Solution LLP, with its registered office at FA 44 Lake City Mall, Kapurbawdi, Thane West, 400607, India, and you, the registered user.

 

The Terms outline the non-exclusive, non-transferable, limited, revocable license to use the “App” and related services, including but not limited to allocated telephone numbers, user guides, and other associated services.

 

  1. Interpretation

 

References to singular include plural and vice versa.

References to masculine include feminine and vice versa.

Headings are for convenience and do not affect interpretation.

References to natural persons include their heirs, executors, and permitted assignees, while references to juristic persons include their affiliates and successors.

  1. “App” Services and Account Registration

 

By using this “App,” you agree to these Terms, applicable laws, and regulations. You must register an account (“Account”) to access certain services. When registering, you must:

 

Provide accurate and complete information.

Update your information as needed.

Authorize Rubic Solution to verify your information as required by applicable law.

Comply with applicable policies, including service quality, confidentiality, user integrity, anti-harassment, and conflict of interest.

You are responsible for maintaining the confidentiality of your account information and for all activities under your account. Notify Rubic Solution immediately of any unauthorized use.

 

  1. Duties of a User

 

You must comply with all local laws and regulations. You should report any technical issues with the “App” and use the Services only for their intended purposes. Prohibited activities include:

 

Sharing offensive or inappropriate content.

Harassing or threatening others.

Conducting illegal activities like gambling or pyramid schemes.

Falsifying or deleting author attributions.

Using automated tools to access or monitor the “App.”

Engaging in unauthorized reverse engineering or modification.

Violating any applicable laws, rules, or regulations.

  1. Rights of the Parties

 

No relationship beyond that of a service provider and user is created. Rubic Solution reserves the right to terminate this Agreement unilaterally.

 

  1. Declarations, Representations, Warranties, and Covenants

 

Each party represents it has the authority to enter into this Agreement. Users must comply with all laws and have no criminal convictions. Users should not use the Services for purposes outside those specified in the Terms and must comply with local laws regarding call recording functionality.

 

  1. Third-Party Content

 

Rubic Solution is not responsible for the content of third-party sites linked to the “App.” We may disable links but are not obligated to do so.

 

  1. Intellectual Property

 

Rubic Solution owns all rights to intellectual properties related to the “App.” You are granted a limited license to use these properties in accordance with this Agreement, but no ownership rights are transferred.

 

  1. Confidentiality

 

You agree to keep confidential all technical and non-technical information obtained from Rubic Solution. Confidential information excludes information already known, obtained from a third party without confidentiality obligations, publicly available information, or information required to be disclosed by law.

 

  1. Termination

 

Either party can terminate the Terms. You may terminate by stopping use of the “App” or not renewing your subscription. Rubic Solution may terminate if you fail to comply with these Terms. Upon termination, you must stop using and return allocated LeadAtmos Numbers.

 

  1. Payments

 

Subscription Plans: Details of subscription plans and pricing will be updated on the “App.”

Invoices: Rubic Solution will issue invoices based on the selected plan.

Renewal: Subscription renewal requires advance payment. Failure to pay will result in cessation of services.

Irregular Payments: Failure to make regular payments may result in termination of the subscription.

Payment Options: Multiple payment options are available. Rubic Solution is not liable for payment issues but may assist in resolving them.

 

  1. Refund Policy

 

No refunds are provided.

 

  1. No Warranties

 

The “App” is provided “as is” without warranties. Rubic Solution disclaims all implied warranties and does not guarantee the “App” will be error-free or uninterrupted.

 

  1. Indemnity

 

You agree to indemnify Rubic Solution for any claims or damages arising from your breach of these Terms or violations of law.

 

  1. Limitation of Liability

 

Rubic Solution is not liable for special, incidental, indirect, or consequential damages, including loss of profits or business information.

 

  1. Privacy Policy

 

Use of the Services is subject to Rubic Solution’s Privacy Policy available at Privacy Policy.

 

  1. Updates

 

We may update these Terms at our discretion. Continued use of the “App” after updates signifies acceptance of the revised Terms.

 

  1. Severability

 

If any term is found to be illegal or unenforceable, it will be severed, and the remaining Terms will continue in effect.

 

  1. Force Majeure

 

Rubic Solution is not liable for performance delays due to events beyond its control. Performance may be suspended or terminated if the force majeure event persists for more than 30 days.

 

  1. Non-Assignment

 

You may not assign or transfer your rights under these Terms to any other person.

 

  1. Governing Law, Jurisdiction, and Dispute Resolution

 

These Terms are governed by the laws of India. Disputes will be resolved in the courts of Thane, India.
